Dear Boater,
Nichols Yacht Yard is committed to protecting the environment in which we live and work and to maintaining a clean, safe and orderly marina. All boat owners, guests, contractors, service providers and other persons using the Marina are required to comply with applicable environmental and safety requirements, the Nichols Yacht Yard Storage Agreement and Marina Rules, and the management practices contained in our Stormwater Pollution Prevention Plan (SWPPP).
IMMEDIATELY NOTIFY MARINA STAFF IN THE EVENT OF A FIRE, ACCIDENT, FUEL OR OIL SPILL, OR ANY OTHER RELEASE OF A CONTAMINANT.
In an emergency involving injury, fire, or an immediate threat to life or property, call 911. Anyone responsible for a spill or discharge is also responsible for complying with any applicable governmental reporting and cleanup requirements. Notification to Nichols Yacht Yard does not replace any independent legal reporting obligation.
*PROTECTING THE WATER AND MARINA PROPERTY*
Do not throw, discharge, deposit, wash, hose, or otherwise allow sewage, garbage, refuse, oil, fuel, chemicals, contaminated bilge water, paint debris, solvents, or other pollutants to enter the Marina basin, harbor, docks, grounds, or stormwater drainage system.
Materials, supplies, debris, or waste may not be left on docks, walkways, pavement, shoreline areas, or elsewhere on Marina property where they may be spilled, blown, washed, or otherwise carried into the water or stormwater system.
Do not discharge oil, gasoline, diesel fuel, solvents, chemicals, flammable liquids, contaminated bilge water, or other petroleum products into Marina waters. Excessive discharge of unburned fuel or petroleum products through vessel exhaust systems is also prohibited.
Gasoline or diesel fuel cans, refueling from portable containers, and storage of fuel containers are not permitted at the Marina.
Vessel sewage may not be discharged into Marina waters. A pump-out service is available through the Marina.
*WASTE AND MATERIAL DISPOSAL*
All garbage and ordinary refuse must be placed in the appropriate containers provided by the Marina. Used oil, fuel, solvents, chemicals, antifreeze, batteries, paint-related materials, contaminated absorbents, petroleum residues, and damaged or worn parts containing regulated materials require proper handling and disposal. These materials may not be left on the ground, docks, walkways, or work areas or placed in ordinary trash containers unless specifically permitted. If you are uncertain how a material should be handled or disposed of, please contact the Marina office before disposing of it.
*WORKING ON BOATS AT NICHOLS*
Boat owners, contractors, subcontractors, employees and agents may perform only work permitted by Nichols Yacht Yard. Any permitted work must be conducted in accordance with Marina rules, environmental and safety requirements, the SWPPP, and instructions issued by Marina management.
Owner- or contractor-performed sanding, grinding, paint removal, bottom preparation, painting or spray painting is not permitted anywhere on Marina property.All below-waterline work, including bottom painting and zinc replacement, must be performed by Nichols Yacht Yard personnel.
Painting, staining, varnishing, or other work involving coatings or similar chemicals while a vessel is in the water or at the docks may be performed only by Marina personnel. These restrictions are intended to maintain consistent environmental controls, workplace safety, yard scheduling and cleanliness throughout the facility.
*OUTSIDE CONTRACTORS*
No outside contractor, service organization, subcontractor or other person may perform work on a vessel at Nichols Yacht Yard without prior written approval from Marina management. All approved outside contractors must provide the insurance documentation required by Nichols Yacht Yard before beginning work, including a minimum $1,000,000 Certificate of Liability Insurance naming Nichols as required by the Storage Agreement and appropriate proof of workers’ compensation coverage. Approved contractors must sign in and out at the Marina office each time they enter the property to perform work and may work only during permitted hours and in authorized areas.Approval of an outside contractor does not authorize that contractor to perform work that is reserved exclusively to Nichols Yacht Yard personnel or a Marina-selected vendor. Day laborers or other unapproved persons brought onto Marina property to work on a vessel will not be permitted to perform work and may be asked to leave the property.
*MARINA SAFETY*
Swimming, diving, fishing, paddle boarding, canoeing and kayaking are not permitted from boats, docks, finger piers or other areas of the Marina. No scuba diving or underwater work is permitted anywhere in the facility. Charcoal fires and other open fires are not permitted except in areas specifically designated by Marina management. Minor children must be accompanied by an adult while at the Marina. Running and bare feet are not permitted on docks. Properly fitted personal flotation devices are strongly recommended for children and non-swimmers. Dogs and other pets must be leashed, and owners are responsible for promptly cleaning up after them. Walkways and docks must remain clear. Supplies, equipment, accessories, debris or other materials may not be stored on or obstruct docks or walkways.
*COMPLIANCE AND ENFORCEMENT*
Boat owners are responsible for ensuring that their guests, contractors, employees and agents understand and comply with applicable Marina rules.Nichols Yacht Yard reserves the right to immediately stop, restrict or prohibit any work or activity that Marina management believes may create an environmental, safety, insurance, operational or contractual concern. Nichols Yacht Yard also reserves the right, at reasonable times, to inspect vessels and work areas for compliance with environmental, safety and Marina requirements. This right to inspect is discretionary and does not create an obligation on the part of Nichols Yacht Yard to continuously inspect or monitor any vessel.
Failure to comply with these requirements may constitute a violation or default under the applicable Storage Agreement and Marina Rules and may result in suspension of work privileges, removal of a contractor or other person from Marina property, termination or revocation of privileges as permitted by the applicable agreement, or other appropriate action. Any boat owner, contractor or other responsible party causing or permitting a prohibited spill, discharge, release or other environmental violation may be responsible for resulting cleanup costs, damages, fines, penalties and other expenses to the extent provided by the Storage Agreement and applicable law. All Marina patrons must comply with applicable federal, state, county and local laws and regulations as well as Nichols Yacht Yard’s Marina Rules and Storage Agreement. If you have any question about whether work is permitted, whether a contractor is approved, or how a material should be handled or disposed of, please contact the Marina office before beginning the work. This Environmental Message summarizes selected Nichols Yacht Yard environmental, work and safety policies. The current Storage Agreement, Marina Rules and applicable law control in the event of any inconsistency. Your cooperation in keeping your marina and Mamaroneck Harbor clean and safe is sincerely appreciated.
